Terms of Use
Article 1 (Definitions)
For the purposes of these Terms of Use, the following terms shall have the meanings set forth below.
- “Terms” means these Terms of Use.
- “Operator” means the entity that provides the “Exam Timer” application.
- “Service” means the “Exam Timer” application provided by the Operator.
- “User” means any person who uses the Service.
Article 2 (Applicability)
These Terms shall apply to all relationships between the User and the Operator regarding the use of the Service.
Article 3 (Registration)
The Service may be used without any special registration. However, use of certain features (paid subscriptions) requires completion of the procedures specified by third-party platforms (the App Store, Google Play, etc.).
Article 4 (Handling of Personal Information)
The Operator shall appropriately handle Users’ personal information in accordance with the Privacy Policy separately established by the Operator. By using the Service, Users are deemed to have agreed to the Privacy Policy. The Privacy Policy can be reviewed at the following URL:
Article 5 (Paid Services and Subscriptions)
Certain features of the Service may be offered as paid subscriptions. The fees and subscription periods for paid subscriptions shall be displayed on the in-app purchase screen. Subscriptions are subject to the terms and conditions of the applicable third-party platform (the App Store, Google Play, etc.).
1. Timing of Charges
Paid subscriptions will be charged to the User’s Apple ID or Google account at the time of purchase confirmation.
2. Automatic Renewal
Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current subscription period.
3. Cancellation
Subscriptions must be canceled through the account settings of the relevant platform. Uninstalling (deleting) the Service alone does not cancel the subscription.
4. Refunds
Except as required by applicable laws, cancellations and refunds after purchase of a paid subscription during the subscription period are generally not accepted. Refunds shall be handled in accordance with the policies of the applicable third-party platform (the App Store, Google Play, etc.).
Article 6 (Use by Minors)
If a minor uses the Service, consent must be obtained from a parent or other legal guardian. The same consent is required when a minor purchases a paid subscription.
Article 7 (Prohibited Conduct)
Users shall not engage in any of the following activities when using the Service:
- Acts that violate laws or public order and morals
- Acts that interfere with the operation of the Service
- Unauthorized access or attempts thereof
- Any other acts deemed inappropriate by the Operator
Article 8 (Suspension and Termination)
If the Operator determines that a User has violated these Terms or may interfere with the operation of the Service, the Operator may, without prior notice, suspend all or part of the User’s use of the Service or terminate the user agreement.
Article 9 (User Liability for Damages)
- If a User violates these Terms or causes damage to the Operator in connection with use of the Service, the User shall be liable to compensate the Operator for all damages incurred, including attorney’s fees.
- If a dispute arises between a User and a third party in connection with use of the Service, the User shall resolve such dispute at their own responsibility and expense and shall not cause any inconvenience or damage to the Operator.
- If the Operator receives a claim or is subject to legal action by a third party due to the User’s violation of these Terms, the User shall resolve such matter at their own responsibility and expense in accordance with the Operator’s request.
Article 10 (Disclaimer)
- The Operator does not guarantee the accuracy, completeness, or usefulness of the content of the Service.
- The Operator shall not be liable for any damages incurred by Users arising from use of the Service, except in cases of willful misconduct or gross negligence by the Operator.
- The Operator may change, add to, suspend, or discontinue the Service, in whole or in part, without prior notice.
Article 11 (Usage Environment)
- Users shall prepare and maintain, at their own responsibility and expense, the devices, software, and internet connection necessary to use the Service.
- All communication charges and other costs incurred in connection with use of the Service shall be borne by the User.
- The Service is provided based on specific operating systems and device environments, and depending on the User’s environment, all or part of the Service may not function properly.
- The Operator shall not be liable for any malfunctions or damages arising from the User’s usage environment.
Article 12 (Prohibition of Assignment)
Users may not assign, transfer, pledge, or otherwise dispose of their position under these Terms or any rights or obligations arising from these Terms to any third party without the prior written consent of the Operator.
Article 13 (Copyright)
All copyrights and other intellectual property rights related to the Service belong to the Operator or to third parties who hold legitimate rights.
Article 14 (Amendments to the Terms)
The Operator may amend these Terms without notice to Users when deemed necessary. The amended Terms shall take effect when posted within the Service or on related pages.
Article 15 (Notices and Communications)
- Notices from the Operator to Users shall be provided by any of the following methods:
- Notices within the Service
- Posting on the Operator’s website
- Any other method deemed appropriate by the Operator
- Notices provided by the methods set forth in items (1) or (2) above shall take effect at the time they are posted.
Article 16 (Governing Law)
These Terms shall be governed by and construed in accordance with the laws of Japan.
